Terms of Use

Freshice helps product teams, design teams, founders, design leaders, product managers, agencies, and other professional users review digital products and product work. Freshice may allow you to record screens, capture voice input, use AI-assisted features to transcribe and structure feedback, create review sessions and outputs, share review outputs with collaborators, and manage projects and review workflows.

Freshice is a professional productivity and collaboration tool. It is not intended for personal surveillance, employee monitoring without proper notice, consumer screen recording, unlawful recording, or any use that violates privacy, confidentiality, intellectual property, recording, or other applicable laws.

Freshice is intended only for business, professional, product, design, research, agency, startup, and organisational use. You may use Freshice only if you are legally able to enter into a binding agreement, are at least 18 years old, are not barred under applicable law, are using the Service for lawful professional purposes, and have authority to use any content you record or process through Freshice.

Freshice is not intended for children. You may not use Freshice to knowingly collect, process, or record personal data of children without all required legal authority and safeguards.

You must provide accurate, complete, and current account information. You are responsible for maintaining the confidentiality of login credentials, all activity under your Account, actions and omissions of your Authorised users, configuring permissions and sharing settings appropriately, and promptly notifying us of suspected unauthorised access.

Account credentials may not be shared between individuals. We are not responsible for losses caused by your failure to secure your Account.

Subject to your compliance with these Terms and payment of applicable fees, Freshice grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Service during the applicable subscription, trial, alpha, beta, or access period, solely for your internal business or professional purposes.

You receive no ownership rights in Freshice, the Service, our software, AI systems, models, designs, or intellectual property. All rights not expressly granted are reserved by Freshice.

Freshice may be offered as an invite-only, alpha, beta, preview, experimental, early access, free, or trial product. You understand that such features may be incomplete, unstable, or changed without notice; may contain bugs, errors, or data loss risks; may not be suitable for confidential or production-critical use; and are provided as-is without any warranty, uptime commitment, or obligation to continue.

We may revoke invite-only, alpha, beta, free, or trial access at any time, for any reason, without liability.

You are solely responsible for ensuring every recording, upload, review, sharing action, and processing activity complies with applicable laws, contracts, workplace policies, client agreements, recording laws, privacy obligations, and professional obligations.

You represent and warrant that you have all rights, licences, permissions, and consents required to record, upload, process, store, use, and share Customer content through Freshice — and that you will not use Freshice for secret, deceptive, unlawful, or unauthorised monitoring, surveillance, or recording.

As between you and Freshice, you retain ownership of your Customer content, subject to the rights granted to Freshice under these Terms. Freshice does not claim ownership of your underlying product designs, recordings, screenshots, audio, comments, or transcripts.

You grant Freshice a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, copy, transmit, process, analyse, display, reproduce, and otherwise use Customer content as reasonably necessary to provide, operate, maintain, secure, and improve the Service; enable sharing and collaboration; troubleshoot and improve performance; detect and prevent abuse; provide support; and comply with law.

Authorised Freshice personnel, contractors, service providers, and systems may access, view, process, or use your recordings, files, transcripts, and other Customer content when reasonably necessary for troubleshooting, debugging, support, product improvement, security, abuse prevention, and legal compliance. We use reasonable internal controls to limit access to those with a legitimate need.

Freshice may collect, generate, analyse, and use Usage data for any lawful business purpose. We may use aggregated, anonymised, or de-identified data to improve Freshice, measure performance, develop new features, and support business reporting — provided such reporting does not identify you or disclose your confidential Customer content. Freshice owns all aggregated and de-identified data.

AI features may produce Output that is inaccurate, incomplete, biased, misleading, or unsuitable for your purpose. You are solely responsible for reviewing Output before relying on it; editing, approving, or rejecting Output; ensuring Output complies with applicable laws and contracts; and not relying on AI Output as a substitute for human judgement or professional review.

Freshice may use Customer content, Input, Output, recordings, transcripts, metadata, and Usage data to maintain, test, analyse, improve, and develop the Service, including AI-assisted features, as permitted by our Privacy Policy, applicable law, and your plan settings. Do not submit sensitive, regulated, or confidential content unless you are authorised and have reviewed our applicable data handling terms.

If you provide ideas, suggestions, bug reports, or other feedback about Freshice, you grant Freshice a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable right to use, copy, modify, and commercialise that feedback without restriction, attribution, or compensation.

You must not use Freshice to violate any law or third-party right; record any person without required consent or lawful basis; upload unlawful, harmful, abusive, defamatory, infringing, or objectionable content; capture sensitive personal data without safeguards; reverse engineer or copy the Service; probe or bypass security controls; build a competing product; use unauthorised automated systems; overload or disrupt the Service; or resell or sublicense access without written permission.

You must not upload, record, process, or share Customer content unless you have the right to do so. You are solely responsible for ensuring Customer content does not infringe intellectual property rights, violate confidentiality or privacy obligations, contain unlawful material, or contain data subject to export control, government secrecy, or regulatory restrictions that would make use of Freshice unlawful.

Freshice does not control and is not responsible for third-party products, content, terms, privacy practices, security, or availability. Your use of third-party products is governed by the third party's terms. Freshice is not responsible for losses arising from third-party products or broken integrations.

You are responsible for choosing appropriate sharing settings, ensuring recipients are authorised to view content, revoking access when no longer needed, and not sharing confidential or regulated content without authority. Freshice is not responsible for unauthorised access caused by your sharing choices or failure to revoke access.

Each party will use the other's confidential information only to perform or receive the Service and will use reasonable care to protect it. Confidentiality obligations survive termination for five years, except trade secrets, which remain protected for as long as they qualify under applicable law.

Freshice's handling of personal data is described in our Privacy Policy. You are responsible for providing required privacy notices, obtaining required consents, establishing a lawful basis for processing, and ensuring your use of Freshice complies with applicable privacy and data protection laws.

Freshice will use commercially reasonable measures designed to protect the Service and Customer content. However, no online service is fully secure. You are responsible for managing devices, credentials, permissions, sharing settings, and internal security policies. You must notify us promptly of any suspected security incidents.

Freshice may update, modify, suspend, limit, or discontinue any part of the Service at any time. We do not guarantee uninterrupted availability, uptime, recording success, transcription accuracy, or AI accuracy unless expressly stated in a signed written agreement. Support may be provided at our discretion.

You agree to pay all applicable fees. Unless otherwise stated: fees are billed in advance; fees are non-refundable; subscriptions renew automatically unless cancelled before renewal; you are responsible for all applicable taxes. We may change pricing at any time. Price changes apply from the next renewal unless a signed written agreement states otherwise.

Freshice may apply limits to recordings, storage, AI credits, collaborators, projects, API calls, and other usage. You must not attempt to bypass, manipulate, or circumvent usage limits, billing rules, or technical restrictions.

Freshice may retain Customer content for as long as necessary to provide the Service, comply with law, and resolve disputes. Deletion may not immediately remove content from backups or logs. You are responsible for exporting Customer content before termination. Freshice has no obligation to preserve Customer content after termination unless required by law.

Freshice and its licensors own all rights in and to the Service, including all software, APIs, workflows, designs, AI methods, algorithms, documentation, trademarks, and related intellectual property. You may not copy, modify, reverse engineer, or create derivative works from Freshice except as expressly permitted. No rights are granted by implication or otherwise.

Unless you opt out by emailing us at sunit@designsingh.in, you grant Freshice permission to use your organisation name and logo in customer lists, marketing materials, pitch decks, and case studies. We will not publish detailed case studies or disclose confidential Customer content without your permission.

If you submit testimonials, quotes, reviews, or public-facing statements about Freshice, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, publish, and create derivative works from them for marketing and business purposes.

Freshice does not provide legal, compliance, design, product, accessibility, employment, security, financial, or professional advice. Any AI-generated Output is informational and assistive only. You remain responsible for all product, design, business, legal, and operational decisions.

To the maximum extent permitted by law, Freshice is provided on an "as is" and "as available" basis. Freshice disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted use. You use Freshice at your own risk.

To the maximum extent permitted by law, Freshice will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, business, goodwill, or use. Freshice's total aggregate liability for all claims will not exceed the amount actually paid by you to Freshice in the one-month billing period immediately before the event giving rise to the claim.

You will defend, indemnify, and hold harmless Freshice and its affiliates, directors, officers, and employees from claims arising out of your use or misuse of Freshice; Customer content; your failure to obtain consent or establish a lawful basis for recording; your violation of privacy, recording, intellectual property, or other laws; your breach of these Terms; or your Authorised users' acts or omissions.

You may stop using Freshice at any time. Freshice may suspend, limit, or terminate your access at any time if we believe you violated these Terms, failed to pay fees, or your use creates legal, security, or operational risk. Upon termination, your right to use Freshice ends immediately and you remain responsible for unpaid fees and obligations incurred before termination.

If you believe content on Freshice infringes your copyright or other intellectual property rights, contact us at sunit@designsingh.in with your name and contact details, identification of the work allegedly infringed, identification of the allegedly infringing content, a good-faith statement that use is not authorised, and your signature.

You may not use Freshice if you are located in or subject to applicable sanctions or trade restrictions, or if you are listed on any restricted party list. You must comply with all applicable export control, sanctions, and trade laws.

We may update these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms, emailing you, or notifying you in-product. Your continued use of Freshice after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using Freshice.

These Terms are governed by the laws of India, without regard to conflict of law principles. The courts located in Bengaluru, Karnataka, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. If you download or access Freshice through an app store, browser extension marketplace, or platform, additional terms from that provider may apply. Those providers are not responsible for Freshice and have no obligation to provide support, maintenance, warranty, or claims handling for Freshice.

You may not assign, transfer, delegate, or sublicense these Terms or your rights without Freshice's prior written consent. Freshice may assign or transfer these Terms without your consent, including in connection with a merger, acquisition, or sale of assets.

Freshice will not be liable for delay, failure, or non-performance caused by events beyond our reasonable control, including internet failures, hosting failures, cloud provider failures, AI provider failures, natural disasters, war, cyberattacks, government action, power failures, pandemics, or legal changes.

Freshice's failure to enforce any provision of these Terms is not a waiver of that provision. If any provision is found invalid or unenforceable, the remaining provisions will continue in full force and the invalid provision will be modified to the minimum extent necessary to make it enforceable.

These Terms do not create a partnership, joint venture, employment relationship, agency relationship, or fiduciary relationship between you and Freshice. Neither party has authority to bind the other except as expressly stated in these Terms.

These Terms, together with the Privacy Policy, any applicable Data Processing Addendum, Order Form, plan terms, and product-specific terms, constitute the entire agreement between you and Freshice regarding the Service and supersede all prior agreements, understandings, and communications.
